Kenya National Union of nurses secretary general who was also a candidate for the Kakamega senatorial seat Seth Panyako wants IEBC Chairman Wafula Chebukati removed for allegedly changing the results for the position by increasing the final tally by 29,746 votes.

Panyako has filed a petition with the clerk of the National Assembly, which will be discussed by the Justice and legal affairs committee. The committee has already termed the issue as serious.

In the petition, the trade unionist says that  Chebukati usurped imaginary powers  and changed the results disregarding the pronunciation by the returning officer.

“In blatant disregard of the result declared by the returning officer for the purported winner, Chebukati gazetted that Malala had garnered 258,178 votes which was 29,746 votes more than the 228,432 votes declared by the Returning Officer. The increment of the difference between the two top candidates to over 59,126 was unjustified and illegal,” he said in the petition.

Seth Panyako said that Chebukati’s action contravened article 38 and 86 of the constitution. He said that this showed that he was conflicted in his duties and was not fit to hold the office of the chairman of the IEBC.

This is the second time that that a candidate has asked for the removal of the Wafula Chebukati .

Former Presidential hopeful Peter Gichira had accused the embattled chairman of refusing to allow him to present the list of nomination signatures, which he said contravened Article 47 of the constitution of fair administrative action.
