The High court has said that all the presidential candidates who were presidential in the August 8 polls should be in the ballot paper in the October 26 fresh presidential elections.
The court said that it would discriminatory to not allow Ekuru Aukot to be on the ballot as it was a violation of his human right to political participation.
The High court has defined the word ‘fresh’ under article 140(3) of the constitution should not be embossed with article 138(5)of the constitution as they serve different situations and not a similar scenario.

He said that the fact the Supreme Court ordered for fresh elections and nullified the August polls meant that the elections were void and that it was the right of all presidential candidates to appear on the ballot.
The petition cannot be deemed as he conceded defeat as he supported the petition as an interested party.
