Former Cabinet Secretary Raphael Tuju recorded a statement with the Directorate of Criminal Investigations (DCI), accusing senior lawyer Fred Ojiambo of fabricating evidence and filing false affidavits in court in cases linked to the East African Development Bank (EADB).
Tuju said he submitted his statement to investigators on Monday morning, accompanied by court records and affidavits which he claims demonstrate a pattern of falsehoods allegedly manufactured and deposited before the High Court and the Supreme Court of Kenya.
According to Tuju, Ojiambo and other lawyers at Kaplan & Stratton procured affidavits from a former Kenya Country Manager of the bank which he alleges contained false information.
He further claims the affidavits were fraudulently presented as having been properly sworn before a Commissioner for Oaths.
Tuju also referenced an ongoing criminal case against the EADB at the Magistrates Court, in which Ojiambo is representing the bank.
He alleged that the matter has stalled for over a year after the lawyer invoked what Tuju described as a “non-existent diplomatic immunity” at the High Court.
The former minister argued that the alleged falsehoods forming the basis of the Magistrates Court case are similar to those previously filed at the Supreme Court in matters involving him and his family business, Dari Limited.
Tuju said he has been advised by his legal counsel that the alleged actions amount to criminal offences under the Penal Code, including fabricating evidence contrary to Section 113, conspiracy to defeat justice and interference with witnesses contrary to Section 117 and providing false information to a person employed in the public service contrary to Section 129.
He further alleged that attempts had been made to intimidate him through what he described as a “fake international warrant of arrest” issued by a Ugandan magistrate’s court in connection with the same dispute.
Tuju claimed the matter raises broader concerns about integrity within the legal profession, arguing that senior titles such as Senior Counsel should not shield individuals from accountability.
His complaint comes at a time when Peter Gachuhi, a senior partner at Kaplan & Stratton, is reportedly facing legal scrutiny in a separate matter involving allegations of forgery linked to the will of former Attorney General James Boro Karugu.
Tuju maintained that his report to the DCI is aimed at seeking investigations and possible prosecution, saying the issues he has raised are now “on record.”
Efforts to obtain a response from Fred Ojiambo and Kaplan & Stratton were not immediately successful.
The DCI said they will investigate the claims and make necessary recommendations to the Office of the Director of Public Prosecutions for action.
