The National Super Alliance (NASA) is free to swear in their leader, Raila Odinga as President as long as they do not interfere with the normal operations of the country, Government spokesperson Eric Kiraithe has said.

Speaking at KICC, Kiraithe noted that the opposition’s inauguration ceremony would not affect that of President Uhuru Kenyatta.

”They can go ahead and swear in Raila. If they do so without interfering with the people, the government will not be concerned,” he said, adding that one can sit with friends and declare self pope without using public resources.

He did however caution the opposition against unlawful assemblies saying that they would be met with the ‘full wrath of the law.’

This comes as NASA leadership threatens to sear in Odinga as the ‘People’s President’ at Uhuru Park on Tuesday, November 28 as will Kenyatta but at Kasarani stadium.

The opposition has maintained that their leader was rigged out of the August 8 election hence their continued fight for electoral justice through the formation of the People’s Assemblies that Kiraithe said are ‘unconstitutional, disregard to the rule of law and a subversive ambition.’

The spokesperson said that ward representatives who have passed the motion in their respective county assemblies be surcharged for misuse of public funds.

β€œIt is my hope that those MCAs who wasted public resources to pass those motions would be surcharged for using public resources for private activities. Your freedom of assembly is in the constitution. You can sit with your friends anywhere and even declare yourself the Pope, but using public resources to pass things which are not covered anywhere will not be allowed,” he said.

The motions have so far been adopted in 9 counties; Kisumu, Siaya, Vihiga, Busia, Kilifi,Migori, Makueni, Homa Bay, and Kakamega but were temporarily put on hold by Justice Lilian Mutende on Monday.

He also added that 20 heads of state have confirmed their attending Kenyatta’s swearing in ceremony.
