    Lawyer Wants Maraga, Mwilu Removed From JSC Over Gross Misconduct

    A lawyer has accused Chief Justice David Maraga, his deputy Philomena Mwilu and five members of the Judicial Service Commission of ‘serious violation of the Constitution.’

    Adrian Njenga has petitioned the National Assembly and is seeking to have them removed from office for gross misconduct.

    “The aforementioned have failed to promote and facilitate the independence and accountability of the Judiciary and the transparent administration of justice,” the lawyer says.

    He also argues that the seven have ‘without any constitutional regard or justification dismissed petitions presented to the JSC.’

    The other members of JSC, Mr Njenga wants gone are: Justice Mohammed Warsame, Aggrey Muchelule, Tom Ojienda, Emily Ominde, and Mercy Deche.

    On September 14, 2017 Nyeri MP Ngunjiri Wambugu filed a petition before the JSC seeking the removal of CJ Maraga from office.

    Ngunjiri accused the CJ of not going through all the evidence presented before him before arriving at his decision to annul President Uhuru Kenyatta’s election on 1 September.

    The newly elected legislator also accused Maraga of influencing the decision taken by the other three judges who called for the nullification of ‘the people’s will.’

    Ngunjiri later dropped the petition upon the President’s request.
