    Super Metro to resume operations as tribunal lifts suspension

    The Transport Licensing Appeals Board (TLAB) Monday suspended a directive issued by the National Transport and Safety Authority (NTSA) that halted the operations of a bus company Super Metro.

    In the ruling, TLAB Chairman Dr. Adrian Kamotho, lifted NTSA’s March 18, decision allowing Super Metro to resume its services in compliance with the law.

    The ruling follows an urgent application filed by the sacco on March 19, challenging the suspension.

    “This order be immediately served upon the Inspector General of the National Police Service,” said Kamotho.

    The Sacco argued that NTSA’s decision was based on extraneous material or evidence and the bus company was not given a chance to refute the claims in contravention of the principle of nature justice.

    TLAB certified the matter as urgent and directed that NTSA be served with the appeal documents and respond by March 25.

    The board further ordered that the appeal and motion be heard inter-parties on March 27.

    “Pending inter-partes hearing of the Motion and the Memorandum of Appeal herein on Thursday, 27th March 2025, an interim Order is hereby issued staying the execution/enforcement/operation of the decision of the Respondent dated 18th March 2025 (NTSA/C/RT/010/2VOL. (1)), suspending the operations of the appellant herein, SUPERMETRO Sacco Limited as a PSV Operator. The appellant is at liberty to immediately resume operations in due compliance with the law,” the board said.

    NTSA while suspending the super metro buses operation, said the decision is to ensure the public services vehicles company is compliant with road safety measures.

    “This is to notify the Public that the Authority has suspended Super Metro Limited’s operator license until the Company fully complies with the Public Service Vehicles Regulations, 2014 and other set conditions,” NTSA said in a statement.

    “The decision was necessitated by the need to ensure the Company is not only compliant but that it has put in place safety measures to protect the lives of its passengers and other road users.”

    NTSA alleges that the suspension follows various violations by the operator, including expired inspection certificates and road service licenses, expired speed limiter certificates, lack of speed limiter records and vendor details among others.
