Activist Okiya Omtatah has filed an affidavit to High Court in a bid to challenge the state appointments by President Uhuru Kenyatta, last week.

According to Omtatah, the appointments to Board of State Corporations have not been done on merit as had been directed by the court.

He therefore seeks to have the state appointments annulled by the court.

Omatatah references an order made by the employment court that directed that all state appointment should be done on merit.

The appointments made on February 4 and 8, 2019 by the President saw former Laikipia governor Joshua Irungu appointed the chairperson of the Water Services Resource Board for the next three years.

Acclaimed Sports legend Paul Tergat was also appointed as the chairman of the Kenya Academy of Sports Council, former Mwingi Central MP Joe Mutambu was also a beneficiary as he was appointed chair of the Water Resource Authority.

According to the Constitution of Kenya, all state appointments are to be published in the gazette notice, hence the appointments were to be effected between February 7 and 8.

In January, the High Court ruled that the recruitment of commissioners to the National Cohesion and Integration Commission (NCIC) by the Parliament as unconstitutional.

The petition had also been filed by Omtatah.
