    Nakuru Judge Forced to Hold Court Session in Police Car As Suspect Declined to Alight

    Magistrate Faith Munyi was forced to hold a court session in a police car on Monday after a robbery suspect declined to alight from the vehicle that ferried him for his arraignment in court.

    According to reports, the suspect, Simon Sigei was accused of killing Peter Bore and his daughter Judy Chepkoir after a robbery incident became violent in Boror area, Rongai sub-county.

    Additionally, the suspect was accused of raping the late Bore’s other daughters aged 9 and 12, while in the company of other unidentified armed men.

    The men were said to have been in possession of rungus, machetes and a hammer, on the day that the crime was done.

    Sigei and his accomplices are also accused of carrying Bore’s identity car and Ksh68,000 in cash.

    The authorities revealed that since his arrest on April 23, 2019, Sigei has never uttered a single word even after he was booked at Menegai Police Station.

    Daniel Gichuki, who is the lead investigator in the case, divulged that the suspect has also refused to eat, adding that the authorities had to carry him from the police cells to their vehicle on their way to court.

    Officer Gichuki noted: “The suspect has not responded to any of our questions or any conversation, all he has been doing is sleeping.”

    Following his decline to alight from the vehicle, Magistrate Munyi opted to take her court session to the police vehicle, where she ordered the postponement of the plea hearing to May 6, 2019.

    She ruled: “The accused is to be remanded at the Nakuru GK prison pending the plea and the bond terms application.”

    Magistrate Munyi also ordered that Sigei be taken for mental evaluation at the Rift Valley Provisional General Hospital prior to the second hearing.

    Additionally, she ordered the presence of the deputy registrar of the high court at the next hearing as detailed in section 280 of the Criminal Procedure Code which authorizes an officer of the court to plead on behalf of an accused person who is unresponsive or mute, as was Sigei’s case.
