The Milimani Law Courts in Nairobi released four suspects linked to the alleged staged abduction of Juja MP George Koimburi, ruling that there were insufficient grounds to continue holding them in custody.
The suspects Grace Nduta Wairimu (MCA for Kanyenya-ini Ward), Peter Kiratu Mbari, David Macharia Gatana, and Cyrus Muhia were each granted release on a cash bail of Sh300,000 or an alternative bond of Sh1 million.
As part of their release conditions, the court prohibited the suspects from contacting any witnesses directly or through intermediaries. Magistrate Carolyne Mugo also ordered them to report to the investigating officer weekly or whenever summoned by the Directorate of Criminal Investigations (DCI).
The court also granted the prosecution the liberty to request cancellation of the suspects’ bail at any time should they violate the court-imposed conditions.
The case is scheduled for mention on June 5, 2025.
The four were arrested in connection with the alleged staged abduction of MP George Koimburi, reportedly carried out on May 25, 2025.
They were presented in court under a miscellaneous application in which the DCI sought to detain them for an additional 15 days to allow for further investigation and guidance from the Director of Public Prosecutions (DPP).
The suspects are accused of participating in the alleged abduction with the intent to commit murder, a violation of Section 258 of the Penal Code.
They are also under investigation for allegedly causing a disturbance in a manner likely to breach the peace.
In denying the DCI’s request for extended detention, Mugo stated that the investigative process does not require the suspects to remain in custody.
Koimburi, who is currently hospitalized at Karen Hospital, is suspected of having orchestrated his own abduction.
On Thursday, the Directorate of Criminal Investigations (DCI) released a statement claiming that Nduta spent the entire night of May 25, 2025 with Koimburi at a bar in Gatundu South when the lawmaker had claimed that he had been abducted.
The DCI claimed that MP Koimburi was kidnapped from Full Gospel Ebenezer Church in Mugutha by three of the respondents, who are reportedly his close associates.
The DCI argued that investigations are still ongoing and releasing the suspects at this stage could jeopardize the process, especially since the MP is yet to record his official statement.
According to court papers, the allegations have since created panic, fear, and sharp political divisions across the country and in the concerned constituency, which is cosmopolitan in nature.
“This presents a threat to national peace and stability,” the police said.
They claimed Koimburi remains critically ill, according to close friends and family.
The outcome of his medical condition is uncertain, as doctors have yet to release their findings.
The court was also told that the matter is of grave national security concern.
Besides being a sitting Member of Parliament, Koimburi is affiliated with the newly formed Democracy for the Citizens Party (DCP), which is in opposition to the current government.
This political dynamic has reportedly fueled intense public reaction that could escalate into serious unrest.
The DCI emphasized that kidnapping is a serious offense under the Penal Code.
Preliminary investigations also suggest that after reportedly evading arrest on May 23, 2025, the MP later returned safely to his home in Mugutha.
