A judge directed that a mother, her son and daughter be produced in court Thursday in the murder of psychiatrist Dr Victoria Mutiso.
Justice Kanyi Kimondo directed that Rose Mbithe, her daughter Angela and son Chris Mulwa be detained until Thursday this week when they will be brought back to court.
Rose and her son Chris had accused the State of subjecting them to malicious and unfair treatment as they appeared in court in connection with the murder case.
Dr Mutiso was a psychiatrist and former Director of the African Institute of Mental and Brain Health.
According to a charge sheet Angela, Rose Mbithe Mulwa, alias Rose Mbithe Ndetei, and Chris Mulwa are accused of murdering Dr Mutiso on July 29, 2026, at about 9:30am along Mawensi Road in Kilimani, Nairobi County.
The prosecution alleges that the three acted jointly with other persons who have not yet been brought before the court.
Rose and Chris raised their concerns after the prosecution asked the court to close miscellaneous applications that had been used to detain them while investigations into the murder were ongoing.
Through their lawyer Danstan Omari, the two opposed the State’s request, arguing that there were serious concerns surrounding the manner in which the investigations and prosecution had been handled.
Omari told the court that the defence had only a day earlier challenged an attempt by the State to continue detaining lawyer Angela Mulwa, who is also linked to the murder case.
He questioned why only three suspects had so far been charged with Dr Mutiso’s murder, yet the charge presented before the High Court indicated that the alleged offence was committed jointly “with others not before the court.”
According to Omari, the State also had another miscellaneous application in which investigators had allegedly indicated that the person suspected of pulling the trigger had either not been identified or that a decision regarding that suspect had not yet been made.
He argued that the circumstances raised questions that the defence wanted addressed before the miscellaneous proceedings were brought to an end.
Omari said Mulwa and her son were ready to appear before the High Court and face the charges against them, but maintained that they were aggrieved by the State’s conduct leading up to their prosecution.
The two also sought permission to personally address the court over what they described as unfair treatment by the State.
The prosecution, however, maintained that there was no basis for keeping the miscellaneous applications open because the 21-day period previously granted to investigators had expired and murder charges had since been filed before the High Court.
“The 21 days have collapsed. We now have a charge sheet. We therefore humbly request that the miscellaneous application be closed,” the prosecution submitted.
The State informed the court that the matter had effectively moved to the High Court, where the suspects were scheduled to make their first appearance before Justice Kanyi Kimondo.
It therefore urged the court to formally close the miscellaneous proceedings and allow any outstanding issues to be canvassed before the High Court handling the murder case.
The court subsequently marked the miscellaneous files as closed and directed Rose and her son to raise their grievances before the High Court.
The two are among the suspects facing charges in connection with the murder of Dr Mutiso. The court heard that Dr. Mutiso was fatally shot in Nairobi on July 29, 2026.
Preliminary investigations established that the deceased was involved in a land dispute that was pending before a court in Machakos.
Prior to her death, Dr. Mutiso had reported an incident in which two-armed individuals riding a motorcycle confronted her while she was driving in Nairobi.
The assailants allegedly pointed a firearm at her, but she managed to escape and subsequently reported the incident at Kilimani Police Station.
The DPP’s decision to charge the three suspects follows the conclusion of preliminary investigations by the DCI into the circumstances surrounding Dr Mutiso’s death and the evidence gathered linking the suspects to the alleged offence.
Police are holding at least five suspects in connection with the murder.
They include a police officer, a bodaboda rider and a man who was said to have been the main link in organizing the murder.
A pistol that was used in the attack, a motorcycle and car were recovered in ongoing operations.
Police have linked the murder to a longstanding land dispute in Mlolongo area.
According to the DCI, the killing was carried out with military-style precision, but investigators responded with an equally intensive operation grounded in forensic science, intelligence gathering, digital evidence and inter-agency collaboration. One of the most explosive revelations made by the DCI concerns the alleged involvement of serving police officers in the murder plot.
Police said evidence obtained during the interrogation of a bodaboda rider and a driver led investigators to officers attached to police posts under Kikuyu Police Station.
The DCI identified Inspector of Police Kenneth Kipkemboi Sang, the Officer-in-Charge of Nderi Police Post in Kikuyu as the alleged link between the financiers and the operational team.
Investigators further allege that Sang was the source of the murder weapon. He is currently on the run.
The DCI also announced the arrest of Police Constable Elijah Kibelion Kimoi, attached to Karinde Police Post, whom investigators identify as the alleged shooter.
Another officer, constable Bett Kiplangat Collins of Thogoto Police Post, has been forensically placed at the scene and is also being sought by detectives.
Police described the alleged involvement of police officers as a grave betrayal of public trust and vowed that the Directorate would pursue all suspects regardless of rank or position.
Police disclosed that investigators are pursuing additional leads suggesting that some of the suspects involved in Dr Mutiso’s murder may also be connected to the drive-by shooting of lawyer Kyalo Mbobu, which occurred on September 9, 2025, along Magadi Road.
The investigation remains active and several other individuals who may have acted as surveillance operatives, facilitators, weapon suppliers or coordinators are still being pursued.
