The Director of Public prosecution Noordin Haji has dropped the charges of 8 accused persons in the NYS scandal citing lack of adequate evidence.

They were however released under section 87 of the Criminal procedure code. This means that if more evidence is found they can be charged on the same facts.

Four more persons agreed to be state witnesses for the case that has former PS Lillian Omollo and the former NYS director general Richard Ndubai. They were charged with conspiracy to steal and abuse of  office.

The eight are Clara Mbau, Christopher Malala, Josephat Njoroge, Rodgers Nzioka, Lucas Otieno, Sammy Michuki, Simon Kiiru, and Stephen Muchai.

The DPP also changed the charge shit to alter  the amount of money that is missing from from Ksh468 million to Ksh8 billion. He said that he has enough evidence to show that the accused paid the monies to fictitious companies.
