    Former Ruaraka OCS Nahashon Mutua Sentenced To Death For Murder

    The High Court has sentenced former Ruaraka OCS Nahashon Mutua to death for killing trader Martin Koome in 2013 in a police cell.

    “The Prosecution has proved beyond reasonable doubt that the police caused the deceased suffering while in cells which caused his death,” Lady Justice Stella Mutuku ruled on Thursday.

    Mutua had denied killing Koome in a police cell on December 19, 2013.

    He told the court that Koome was beaten up by cellmates for noise making minutes after he was booked.

    However, the judge found the officer guilty after listening and analysing evidence by 18 prosecution witnesses.

    While making the ruling, Justice Stella Mutuku noted that the deceased, Martin Koome was not assaulted by fellow inmates but by the accused person.

    According to the Prosecution, the former OCS ordered Koome to immerse his head in a drum of water for about 30 minutes.

    It is then that he hit him on the back of his head with a rod and taken back to the cell.

    The Independent Policing Oversight Authority (IPOA) later recommended that Mutua be arrested and charged with murder.

    The DPP was in agreement with IPOA and directed that the accused person be prosecuted.

    Koome died on December 20 while receiving treatment at the Kenyatta National Hospital (KNH).
