
The Supreme Court of Kenya has upheld Fahim Twaha’s election as Lamu Governor dismissing Issa Timamy’s petition.
In its ruling on Wednesday, the judges concurred with the appellate court’s ruling that dismissed Timamy’s case on grounds of merit.
“We are in agreement with the CA that the scrutiny report was considered and irregularities were appreciated,” they said.
Further, the judges noted that the petitioner could not prove allegations of impartiality presented before the court.

In July last year, Timami’s lawyer, Abubakar Yusuf, criticised the lower court’s judge Alnasir Visram for ignoring evidence presented in court during hearing of the petition.
However, Twahib through his lawyer Morris Kilonzo told the court that his client won the election fairly, asking the trial judges to dismiss the case in its entirety.
