Former Machakos senator Johnston Muthama may face jail time after a decision was made by the High Court to reinstate charges of hate speech and incitement to violence. The lower court had initially thrown out the charges citing abuse of powers by the DPP as reason for its decision.The DPP appealed to the High Court following this decision.
Justice Grace Machari however found the appeal by the DPP as merited and therefore ordered the charge sheet to be reinstated and Muthama to appear in court on October 6 in order for the court to set a hearing date.
In July 2016, Muthama was charged with Hate speech and was arraigned in court along side other legislators.He had also been earlier arrested over incitement to violence charges.

If found guilty of the charges ,the former senator faces a jail term of three years or a fine not exceeding one million shillings.
