Supreme Court Judge Mohammed Ibrahim has promised a tough court battle with lawyer Ahmednassir Abdullahi over defamation, following a tween that implicated the judge to corruption.
In a letter addressed to Abdullahi, the judge has given him seven days to retract the words published on his Twitter account and offer an apology
Through his lawyer, judge Ibrahim alleges that the lawyer tried to influence a supreme court judge via WhatsApp before the Wajir gubernatorial ruling but after the judgement came out he accused supreme court judges of taking bribes to rule against his client.
The message read, “I am proud while hearing all the rumours of judges of the supreme court receiving money in sags… and bags… you are the ONLY… ONLY… ONLY judge in the Supreme Court who is not mentioned even once for taking money… and lawyers know that… but lawyers are accusing you of not being firm and strong… and I think you need to retrace your footsteps. Nobody has suffered for this country in that court like you… and in my view and please even if you are always alone… dissent it that where justice and law are… don’t follow the majority blindly when we know the majority in that court is brought together by MONEY (sic)”.
However, immediately after the ruling, Abdullahi tweeted implicating the judge into taking bribes.
“We know from reliable source in the Supreme Court that the 6 judges tied at 3.3 until yesterday afternoon when Justice Ibrahim changed his mind to make it 4.2 What happened? Who lobbed Ibrahim? Why did he change at the 11th hour? Ibrahim must tell Kenyans what we know,” tweeted the barrister.
According to Abdullahi, Justice Ibrahim received the bribe through a member of parliament.
“On Monday I will write a confidential letter to the CJ and disclose to him which judges were bribed and how much money they got and by whom…one of the judges was bribed through a member of parliament and the money taken from the branch of a local bank in Eastleigh,” he added.
Judge Abdullahi has however promised to go to court to make sure Abdullahi faces defamation charges.

“The said publications were libellous, malicious, oppressive and spiteful and were calculated to, and did discredit our client’s good way and reputation, injured, disparaged and lowered his esteem and regard among right thinking members of the local and international society,” read the letter addressed to Abdullahi.
Mr Ahmednassir has since indicated that he will be filing a petition to the Judicial Service Commission and Justice Maraga referred the case to JSC after he was sent a letter by the lawyer.
