A 50-year-old woman and her Form-Three client are in police custody after attempting to procure an abortion in Bomet County.

Reports indicate the 18-year-old girl, a student in Nakuru, traveled all the way to Bomet to seek the help of the woman in terminating her six-month pregnancy.

“We ambushed them in one of the home at Motigo village in Bomet and found that the girl has already paid Ksh2,000 for the service, she was still having a pending Ksh500 in order for the services to be rendered,” Bomet Township Chief Reuben Ngetich told a local media.

Ngetich said the woman, regarded by many as an expert, has been helping many women procure abortion.

However, the local administration lacked tangible evidence to implicate her.

“We are now glad to have the evidence,” he added.

Shortly after the two were arrested; the girl was taken to Longisa County Referral Hospital for examination and later booked at Bomet Police Station as police conclude investigations.

Abortion is illegal in Kenya, unless the pregnancy puts the mother at risk.

In November last year, Kenya’s medical practitioner’s board banned international health organisation Marie Stopes from offering any abortion services.

However, a month later, the ban was lifted and the facility was ordered to comply with relevant laws.

In a statement, Health Cabinet Secretary Sicily Kariuki directed the company to observe all laws that cover its work, as stated in article 26(4) of the Constitution.

Article 26(4) on the Right to Life states: “Abortion is not permitted unless, in the opinion of a trained health professional, there is need for emergency treatment, or the life or health of the mother is in danger, or if permitted by any other written law.”
