    Court certifies as urgent application by firm seeking to occupy property in Mombasa and Nairobi

    The Environment and Land Court in Nairobi certified as urgent an application filed by Mahadi Energy Limited, a Mombasa-based energy firm, and its director Ibrahim Hussein Mahadi in the ongoing property dispute with Shabeel Project Services Limited.

    Justice Mohamed Kullow on Monday directed that the application be served on the respondent within seven days.

    In the case, Mahadi Energy is seeking to lift orders that had barred it from occupying several prime properties in Nairobi and Mombasa, which it claims were sold in illegal and fraudulent auctions.

    The court directed that the respondents file and serve their replying affidavit within 14 days of being served with the application.

    Justice Kullow further ordered that the matter be disposed of through written submissions.

    Mahadi Energy will have seven days from the date of service of the replying affidavit to file its submissions, together with any further affidavits if necessary.

    The respondents will then have seven days thereafter to file and serve their own submissions.

    The case will be mentioned on December 8, 2025, to confirm the filing of submissions and compliance with the directions.

    The judge also issued a penal notice, warning that any party who disobeys or fails to comply with the court’s orders will face legal consequences.

    “Any disobedience or non-observance of the order of the court served herewith will result in penal consequences to you and any other person(s) disobeying and not observing the same,” ruled the court.

    The dispute involves contested properties located along Mtelo Road in South C, Juja Road in Pangani, and Mainland North, Mombasa, which Mahadi Energy says are central to its petroleum importation, storage, and distribution business.
