The defense lawyers for Michael Oyamo argued that the suspect had been denied fundamental rights while in custody.

They claimed that he had been transferred from Homabay to Oyugis even after the court ordered that he should not be transferred

His counsel Ms. Ashioya said that he was not allowed to make a phone call to alert his lawyers of his whereabouts and that he was sampled that is saliva was extracted from the suspect without the knowledge of the counsel.

The prosecution has however the chief magistrate court  sitting in Homabay to give them more time to conduct investigations and wait for the DNA results on the case of Sharon Otieno murder.

According to the prosecution the investigation is being conducted in the highest level of intelligence and therefore more time is required.
