Homa bay Speaker Elizabeth Ayoo will continue carrying on her duties until the matter is heard and determined, the court has ruled.
Ms Ayoo was impeached by the Members of County Assembly last month, accusing her of mistreatment, frequent adjournments among other reasons.
This follows an earlier order by the Employment and Labour Relations Court in Kisumu reinstating Ms Ayoo as the Speaker.
“I therefore extend the interim orders of 16th October 2018 and therefore order the petitioner to be reinstated as Speaker pending hearing and determination of the case,” ruled Judge Nduma Nderi.
Ayoo has been accusing the MCAs of impeaching the her unfairly as she was not given a chance to defend herself.
In her court argument, Ayoo claimed that the threshold needed to impeach the Speaker was not met as, according to her, only 35 MCAs voted against a requirement of 42 in order to meet the 75 percent mark needed as per the Constitution.
She also accuses Homa Bay MP Peter Kaluma of insulting her on local radio stations and even using his Twitter account to incite MCAs against the Speaker and telling them to elect a new Speaker as soon as possible.

On October 16, Ms Ayoo was physically attacked by Kakelo Kokwanyo MCA, Dan Were with a chair after he accused her of altering the list of new office holders.
On November 29, thugs broke into Ayoo’s office and sprayed it with what police believe is livestock pesticide.
The unidentified people also broke furniture which she purchased after others were vandalized.
According to the police at the scene of incident, the chemical sprayed in Ms Ayoo’s office is Triatix which if consumed can kill in minutes.
The hearing of the case will continue on January 31, 2019.
