Nairobi governor Dr. Evans Kidero and his wife Susan Mboya have filed a suit under a certificate of urgency to force the Ethics and Anti corruption commission (EACC) to return some documents that they confiscated stating that they were not part of the investigation.
Their lawyer senior counsel professor Tom Ojienda said that the EACC were in acting in contempt of court as Justice Hedwig Ongundi had given them 72 hours to return the documents that they had confiscated from the couples home. This ruling by the judge was made in November 6 when she instructed EACC and Kidero to make an inventory of assets that had been confiscated.

Among the documents that the county boss wants returned include his will dated August 30, 2015, Documents from the annual general meetings from Mumias sugar and death certificates of his first wife and son.
Susan Mboya’s will written in August 2014 was also confiscated with documents of her properties in the United State . She maintains that they were not part of the investigations.
Both Kidero and Susan his wife claim that the EACC have acted with malice towards them and failed to obey the court orders and using unqualified people during the raid . He said that the valuer who valued their assets at Sh.9 billion was not qualified and may have done wrong valuations.
