
Martin Ndung’u has threatened to institute a class action against Safaricom and demanded that the telecommunication company pays Sh10000 or inconveniences caused during the the M-Pesa outage on December 8.
He said that most subscribers were forced to pay more for electricity, services and even payment to gambling firms during the outage. He said that Safaricom should pay their 24 million subscribers after admitting that there were culpable for the outage.
Ndung’u has given the telco until Thursday December 13 before he institutes the suit stating that it qualifies as a class action. He stated in the demand letter that Safaricom had contravened the customer protection Act of 2012
“Our client proposes that in preparation for the inconvenience, you credit each of the 24 million subscribers with Sh10,000 seeing that you move an average of Sh16.3 billion daily,” the demand letter reads.
In a late night notification, Safaricom informed its customers that the services were back up and running.
“We wish to notify all our customers and partners that all MPesa services are now back up. We deeply regret any convenience caused and thank you for your patience,” an 11.30 pm statement read.

The telecommunications company Safaricom explained that the loss of services was “due to a database degradation.”
ICT CS Joe Mucheru instructed Communications Authority (CA) to investigate Saturday’s MPesa outage in liaison with Central Bank of Kenya (CBK).
“The Ministry has instructed CA to liaise with CBK the cause of this outage and forward a report to the government, including remedial measures that Safaricom will take to ensure this outage does not happen in the future,” a statement by SC Mucheru reads in part.
