    Vihiga County On The Spot For Appointing Senior Legal Counsel Nahashon Kusina With Fake Credentials

    County Assembly members of Vihiga are being put on blast over a county official who was approved and appointed in an unofficial position of Senior Legal Counsel, with fake documents.

    The man, Kusina Nahashon Opanga was officially appointed with effect from 1 October 2014.

    He had various duties such as drafting private member’s bills, giving legal interpretation of acts and bills and giving legal representation of county assembly and the county assembly service board in court proceedings.

    A quick inquiry to the Law Society of Kenya proved that Mr Kusina is not an advocate in the Court of Law, after his name was not found in the system.

    From credential papers seen by Kahawa Tungu, the fake advocate graduated from Busoga University with a Bachelor of Law. From the title of the degree, one can immediately notice that the papers are fake.

    The title of the Degree is plain and does not indicate whether it was an Art or Science degree.

    In 2016, a Vihiga resident petitioned Kusina’s appointment and that of the Assembly clerk Ambaka Kilinga for lack of merit.

    The petitioner Julius Amasiva said their appointments violated the Constitution. In Kusina’s case, he said, he lacked academic credentials to warrant such an appointment.

    Mr Amasiva further argued that the county assembly overturned a decision by the Assembly Service Board to drop the board’s preferred candidates and pick the two.

    “The board conducted interviews and presented a successful candidate to the assembly for approval. The current clerk was not the name presented but was picked. His deputy was picked, despite failing to satisfy the mandatory requirements necessary to assume that post,” said the petitioner.
