    Woman accused of damaging property in Hardy to take plea next week, court directs

    A Kibera Chief magistrate’s court deferred the plea taking of a woman accused of maliciously damaging property worth Sh325,000 after her lawyer told the court that she was unwell.

    Mary Waithira Gikonyo was expected to take plea on Tuesday in a case where she is charged with willfully destroying a main gate, breaking doors to a house, and damaging window panes and CCTV cameras at a residence in Hardy, Lang’ata Sub-county.

    Her lawyer, however, asked the court to postpone the proceedings, saying the accused had fallen ill while in police custody and needed time to seek medical attention.

    “Your honour, we pray that the court defers the plea taking for two weeks. The accused fell ill while in police custody and requires time to seek medical attention,” the defence counsel submitted, while presenting medical documents in support of the application.

    The prosecution did not oppose the request.

    According to court records, the alleged incident occurred on March 22 at Hardy along Kumbe Road, where Waithira, jointly with others not before the court, is accused of damaging property valued at Sh325,000 belonging to one Eric Munene.

    The defence further told the court that the matter arose from a matrimonial dispute.

    They alleged that a related case involving the same parties was already pending before the High Court.

    In her ruling, Principal magistrate Atieno Ogonda allowed the application and directed the accused to deposit a cash bail of Sh20,000 with two contact persons.

    The plea taking was rescheduled to October 28, 2025.
