A judge of the Supreme Court of Kenya, Justice J.B Ojwang’ is being accused of encroaching his neighbor’s land in Kakrao Village, Migori County.

A source privy to the details says that Justice Ojwang’ bought land and settled in Kakrao village in the year 2000 and afterwards started to develop his land.

In 2013, the judge started buying land from the neighbours to develop his home but has since decided to grab a strip of a neighbor’s land where he, in conjunction with the Migori County government built a murram road leading to his house.

Again in 2015, the Supreme Court judge worked with Mikutra Water and Sanitation company to have water pipes fixed through the same grabbed land, leading to his house.

With the help of his wife, Professor Colleta Suda, then at the Ministry of Energy, the judge had security lights erected in the same piece of land without the complainants consent.

The family, which has apparently had the land since 1966 decided to fence their piece of land but the area chief, Pius Amara sent gangs to destroy the fence and has since then been harassed and intimidated by the local administration.

On the material they invited Nation journalists; Bernard Ojwang and Elisha Otieno to provide live coverage but the duo were a no show because the area chief, word had it that he was going to arrest the builders and the journalists.

“On the material day none of the above communicated and when I called, they informed me that they were too busy and Elisha was rude and sounded like he did not know what I was talking about,” read a follow up email to Nation.

According to the victim, who sought anonymity for fear of intimidation, Chief Amara showed up later that night with goons who destroyed the fence.

The family also complains about the Nation journalists conduct who they say were corruptible and aided in frustrating their efforts in getting justice.

“My final question does it means that a poor man cannot get justice? And does NTV only work for the rich and influential members of the society only? What is the role of free press in Kenya? Remember in our national anthem we have a verse that says ‘Justice be our shield and defender’,” the complainant laments.

Kahawa Tungu has also learnt that the complainant has been threatened with arrest from the area OCPD and has also been summoned by the District Officer.

The family does however have an absolute title deed seen by Kahawa Tungu.

“These rich people use hired goons. They could eliminate me,” the source said via phone interview.
