
The fate of Homabay governor Cyprian Awiti lies in the hands of Chief Justice David Maraga and the judges of the Supreme Court.
The judgement which has since be postponed to 2PM from 9AM will determine whether the governor will complete his second term at the helm of Homabay county.

His election was nullified by both the High court and the court of appeal. Justice Joseph Karanja of the High said that the the Homabay gubernatorial election was marred by irregularities.
Governor Awiti then proceeded to the court of Appeal where Justice Philip Waki, Fatuma Sichale and Otieno Odek upheld the decision of the high court over election malpractices.
The petition had been file by his competitor during the election former Kaspul MP Hamilton Oyugi Magwanga.

Awiti has not been in office for almost five months after an eye operation, will be defended by battery of lawyers, led by senior counsel Tom Ojienda, James Orengo and Otiende Amollo, as he fights to overturn the decision to annul his win.
