High Court Judge Justice Odunga has said that the the appointment of the the returning officers and the presiding officers as illegal, he said that the IEBC did not follow regulation 3 of the elections act.
The IEBC failed to provide the political parties with the list of the returning officers as required by the regulations.
The High Court Has However declined to quash the gazette notice that the IEBC had gazetted on October 12.

The case was filed by a civil society organization in Mombasa but was transferred to the court in Nairobi.
