
Governor Cyprian Awiti will remain being the governor Homabay county after the supreme court upheld his election. The court said that the governor was validly elected.
The Supreme court quashed the decisions of the High court and the Court of appeal
His election was nullified by both the High court and the court of appeal. Justice Joseph Karanja of the High said that the the Homabay gubernatorial election was marred by irregularities.
Governor Awiti then proceeded to the court of Appeal where Justice Philip Waki, Fatuma Sichale and Otieno Odek upheld the decision of the high court over election malpractices.
Both courts established that there was sufficient evidence to prove that there was crafty alteration of polling results in favour of the appelant (Cyprian Awiti).

The petition had been file by his competitor during the election former Kaspul MP Hamilton Oyugi Magwanga.
