On November 8 last year, High court judge George Odunga declared that it was wrong to omit Moi day October 10 from being a National holiday

“I hereby grant a declaration that the omission to have the 10th day of October observed as a public holiday as an illegality and in contravention of Section 2(1) as read with part 1 of the schedule to the Public Holidays Act,” Justice Odunga said.

He however failed to prescribe what holiday would be celebrated on this day ad said it was up to parliament to amend the first  schedule of the Public Holidays Act or the minister substitutes the same for another date.

“Unless Parliament amends Schedule 1 of the Public Holidays Act or the minister substitutes the same for another date, October 10 in each year shall continue being a public holiday, ” he said.

Since the promulgation of the new constitution this day has been a normal working day yet Kenyans were already used to celebrating this day. This day was set aside in the old regime to celebrate the second president , Daniel arap Moi.

Kenyans had remained confused as why the drafters of the new constitution thought it right to remove Moi day as a holiday.

Kenyans wait to see if this time the interior CS Fred Matiang’i will actually follow court orders and declare October 10 a public holiday.
