    Lawyers Ahmednasir, Donald Kipkorir Differs With Justice Wakiaga’s Ruling On Jowie’s Bail

    Top lawyers Donald Kipkorir and Ahmednassir Abdullahi have differed with justice James Wakiaga’s ruling on Joseph Irungu alias Jowie on bail.

    They said that the compelling reasons that were used were not courteous in his ruling and that stating that Jowie was a flight risk was a ‘tired’ excuse.

    Ahmednasir tweeted that the conviction rate in Kenya was too low to warrant someone to become a flight risk.

    Denying accused persons bail on the ground that they are "flight risk" is an old tired execuse. Kenyans don't flee their country to avoid trial…with a conviction rate of less than 2% why should any one be scared of trial in a Kenyan court…of course unless you are very POOR.

    Donald Kipkorir on the other hand said that the High court judge was not courteous in his ruling.

    Have read the full ruling of Justice James Wakiaga. With tremendous deference to him, he went beyond the threshold on rulings for Bail. He seems to believe Jowie Irungu is guilty & Jackie Maribe innocent. A Judge must be Courteous, Wise, Sober & Impartial. The Judge failed all.

    Ahmednasir questioned if justice Wakiaga had adequate evidence to show Jowie’s sex life so as to refer him as a woman eater. He said that the only reason Naomi Campbell was referred to as a man eater was to define the number of men she had slept with.

    Naomi Campbell at the height of her career in modelling was called a "man eater" in recognition of the number of men she slept with. So when Judge Wakiaga referred to Irungu "Jowie" as a "woman eater" was he referring to Irungu"Jowie's sex life?..and was such evidence before him?

    Justice Wakiaga denied Jowie bail stating that he had no abode in Kenya and described him as the male version of a “slay queen”.
