Jubilee PartyJustice Njoki Ndung’u has made an application to the judicial service commission asking them to summon former chief justice Dr. Willy Mutunga for him to be cross examined over affidavits that he swore over her misconduct.

Former Chief Justice Willy Mutunga had sworn affidavits saying that Justice Njoki Ndung’u and Jackton Ojwang had in 2015 gone on a go slow that affected the operations of the Supreme Court. The Former chief justice had said that the go slow was not a collective agreement of the courts bench.

The two judges are purported to have gone on a go slow to protest the retirement of former Deputy Chief Justice Kalpana Rawal and Justice Philip Tunoi once they got to the age of 70 which was the prescribed retirement age for judges.
