    DPP Keriako Tobiko Calls For Probe Of Raila Odinga And Kalonzo Musyoka

    The Director of Public Prosecution Keriako Tobiko has called for the investigation and prosecution of NASA presidential candidate Raila Odinga and his running mate Kalonzo Musyoka  after a petition filed by Samuel Waweru.
     

    He said that the two were in contravention of section 132 of the penal code by declaring that there will not be fresh elections on October 26. The DPP has written to the DCI Ndegwa Muhoro asking for the investigation of the two leaders.

    Section 132 of the penal code states that

    ‘Any person who, without lawful excuse, the burden of proof whereof shall lie upon him, utters, prints, publishes any words, or does any act or thing, calculated to bring into contempt, or to excite defiance employed in the public service of or disobedience to, the lawful authority of a public officer or any class of public officers is guilty of an offense and is liable to imprisonment for a term not exceeding three years.’

     

    Keriako Tobiko Raila and Kalonzo investigated for breach of Section13 (k)(i) of the Elections Act, 2016, and for contempt of the orders of the Supreme Court for fresh elections.

    He asked the DCI to conduct the investigations expeditiously and has given him a team of senior prosecutors to offer guidance on technical issues. he has given the director of criminal investigations  21 days to complete the investigations.

    NASA has said that they are ready to go to the elections but will not do so unless their ‘irreducible minimums’ are met. IEBC has however maintained that they will still acquire services of OT morpho, Al Ghurair and with Ezra Chiloba as the CEO.
