    DCI, DPP Fail To Collect Samples Of OCP Fertiliser Alleged To Have Mercury

    Directorate of Criminal Investigations (DCI) and the Director of Public Prosecutions (DPP) have come under attack for failing to go and collect samples of a fertiliser nabbed in June last year for allegedly containing mercury.

    Previous samples that were collected for investigation are said to have been lost/ destroyed, and the DCI and DPP have been reluctant to take new samples for investigation. However, Kahawa Tungu‘s investigative desk discovered that there could be collusion if the arms of law with cartels to do away with cheaper fertilisers.

    Veteran lawyer Paul Muite lashed out at the DCI for conducting shallow investigations while enjoying his sabbatical leave and avoiding the media.

    He gave as an example the cases of attempted murder which former managing director of the Kenya Bureau of Standards [KEBS] Charles  Ogega Ongwae and others are facing and which are related to the importation of a controversial consignment of 3,500 metric tonnes of impounded fertilizer at Bollore Logistics Warehouse in Changamwe constituency, Mombasa county.

    “The charges the accused persons are facing ought to have been proven against them,” he pointed out.

    Muite said he wondered when seeing them attacking the judiciary despite the judges being eager to do their work and thus causing perennial problems in the corridors of justice.

    He was addressing the media after waiting the whole day to witness the collection of samples from a consignment of 3,500 metric tonnes of imported fertilizer by a Moroccan company held at Bollore Logistics Warehouse in Changamwe  constituency Mombasa  county.

    He expressed his disappointment after a government multi-agency team failed to show up to collect fresh samples of the fertilizer alleged to have mercury for fresh testing.

    Muite, who represented the Moroccan company, OCP Group, which had imported the consignment suggested a certain attempt by both the DCI and the ODPP Noordin Haji to bully the courts.

    He told journalists the two arms of government want to ensure they become the extension of the judiciary to make the courts become mere processes of prosecutions and convictions of suspects.

    “I have sacrificed too much and we won’t allow such incidents to continue happening in the corridors of justice,” he cautioned.
