    Former ANC Aspirant Sues Party for Short-changing Him, Demands Sh30 Million in Damages

    A former Amani National Congress (ANC) aspirant has sued the party for allegedly short-changing him.

    In a suit filed before the Political Parties Tribunal, Nelson Ogeto is asking for Sh30 million in damages.

    Mr Ogeto claims he was requested to withdraw from Hamisi Parliamentary race in favour of the incumbent MP Charles Gimose in the lead-up to the general election in 2022.

    The complainant alleges that in exchange, he was offered the Vihiga county assembly speakership, nomination to the National Assembly or EALA or legal advisor to governor of Vihiga.

    Five months after the August 9 elections, the complaint says he is yet to land any of the positions.

    “The party neither lived up to its promises owed nor made an attempt to, despite being in a position to honor the said pledges,” he says.

    “He was omitted in the nomination list to parliament and instead his slot was given to someone else.”

    Ogeto contends that although running for speaker under the Kenya Kwanza flag, which has a sizeable number of elected and nominated members, the party did not express any desire to support him.

    “The party neither supported his bid for the position nor made an attempt in securing it for him,” he continues.

    He points out that notwithstanding the conflict of interest surrounding his nomination, the pledge to nominate him as an EALA MP suffered the same fate when it was presented to Salim Bussaidy, the chairman of the elections board.

    Ogeto claims that despite his efforts, the party treated him with contempt, which constituted a breach of contract and a violation of his rights as a party member, causing him to suffer emotional, physical, reputational, and monetary loss.

    He claims that all the funds and resources he committed to the party nomination process and as a member were wasted and are yet to be reimbursed.

    “The complainant’s reputation in the eyes of the constituents which he had hopes of representing are now viewing him as a leader that could not propel their aspirations they had hoped he would be its flag bearer,” he adds.

    The matter will come up for directions on February 16.
