The preliminary proceedings at the Supreme court began today with lawyers of the 3rd respondent who is president elect Uhuru Kenyatta have applied for documents that were filed on November 7 should be struck out.
The advocates have also asked the Supreme Court to expunge 5 internal memos on the basis that the memos were unlawfully obtained and in contravention of section 27 of the elections act as read with article 50 (3) of the constitution on thee right to a fair hearing.

The Supreme Court deputy registrar confirmed that the petitioners had file two out of the 8 set of petition by the time of the midnight deadline.
The petitioners however claim that the information that the lawyers wanted to be stuck out was information in the public domain and was not obtained illegally and were keen on establishing why the third respondent was keen on protecting the first and second respondent.
The ‘Kura yangu sauti yangu’ also sought to have a random sample audit of the KIEMs kit.
