    High Court Upholds Plastic Bags Ban

    High court has upheld the plastic bags ban saying conserving the environment takes precedence over commercial interests.

    Justice Bernard Eboso said conserving the environment would be threatened if the ban was suspended and public interest at risk.

    Fredrick Njenga and Stephen Mwangi, two plastic bags importers filed the case protesting the decision.

    The duo said that the six-month timeline was not enough for them to clear stock and fulfill contractual obligations.

    β€œThe subject notice is unconstitutional because it is not in keeping with the principles of good governance enshrined in the Constitution β€” accountability, public participation and transparency,” their petition reads.

    The ban will take effect on 28 August 2017.
