Murder suspect Joseph Irungu alias Jowie has withdrawn the application seeking to disqualify Justice Wakiaga for calling him a woman eater.

In his application Jowie had termed Justice Wakiaga as being ‘unreasonably apprehensive’ and had stated that he would not get a fair trial after the Judges remarks calling him a male version of a slay queen.

“That from such comments, it is obvious that in the mind of the judge, I am a hopeless person who depends on women for sex and even kill them if I must,” he said in a sworn statement.

He had applied to the Judicial service commission that disciplinary action be taken against the judge stating that such statements as derogatory and that it brought disrepute to the judiciary.

“I submit that disciplinary action is taken against him including finding that he is not fit to serve as a judge of the High Court so that a process for his removal be undertaken to rid the Judiciary of personnel such as him who bring the institution into disrepute,” Jowie said.

Jowie appealed to be released on bond after his initial application was denied. The judge said that he was a flight risk and did not have a permanent abode in Kenya.

In his ruling today however the Justice Wakiaga ordered that Jowie is given adequate treatment for his gun shot wound or be released to go to a health facility of his choice.

He had been admitted to Kenyatta National Hospital for surgery but was not attended to due to the huge debt owed to the facility by  Kenya Prisons.
