    Man sues IEBC to stop preparations for 2027 polls

    A Nairobi resident and voter has filed a petition at the High Court seeking to stop the Independent Electoral and Boundaries Commission (IEBC) from continuing with preparations for the 2027 General Elections.

    In the case filed under certificate of urgency, Bernard Mwanzia Munguí argues that the current electoral and governance framework is unconstitutional and must be reviewed before the next elections are held.

    Mwanzia has sued the IEBC, the Attorney General, and the Speakers of both the National Assembly and the Senate.

    He is seeking conservatory orders to suspend all IEBC preparatory activities, including budgeting, procurement, and planning, until his constitutional petition is heard and determined.

    In his affidavit, Mwanzia claims that the electoral commission has already begun using public funds in preparation for the 2027 polls, despite unresolved constitutional issues that could render the process invalid.

    “Unless the court intervenes, the IEBC will continue to expend vast public resources on preparations for an election that may later be declared unconstitutional,” he says in his application.

    He further argues that the petition raises “weighty constitutional questions touching on the sovereignty of the people, national values, and the right to good governance.”

    Mwanzia insists that halting the preparations will serve the public interest and prevent unnecessary expenditure should the court later find the current framework unconstitutional.

    He maintains that the urgency of the case is not of his own making, arguing that the IEBC’s electoral calendar and statutory deadlines are already in motion.
