Human Rights Activist, Okiyah Omtatah has sued the IEBC over their decision to not have voters hang around the polling station after voting.

Omtatah is challenging the commission’s decision to have voters stay at least 400 meters away from the polling station.

He filed a petition before Justice Kiarie Waweru saying the decision was unconstitutional and illegal.

Speaking to members of the fourth estate, the activist said the order would prevent the public from the counting, tallying and announcement of the results.

“Kenyans have legitimate expectations that they will vote, wait for results and then go home. If the court does not interdict the violations, the rule of law will be undermined. The respondents will suffer no prejudice if the orders are granted,” he said.

The President has also warned Kenyans against hanging around the polling stations saying that they should go home right after casting their ballots.
