Former nominated senator Gloria Orwoba briefly spent part of the Wednesday night at the Central police cells in Nairobi after her arrest from outside the Parliament Building.
She was later released on Sh10,000 cash bail pending arraignment.
Police said they were preparing charges of creating disturbances and obstruction of justice.
After her arrest, she was taken to Central Police Station where she was processed.
Nairobi police boss George Seda said the investigation team had released her pending possible arraignment.
“She was released on Wednesday evening on goodwill pending possibility of being arraigned with obstruction to justice and creating disturbances. We will proceed with the case,” he said.
He added she left the station with no complaints.
Orwoba had complained of being held at the station without a word.
“I have been detained in the Central Police Station. I am awaiting my charges which are apparently being booked at parliament police station. The central police bosses say that they cannot charge me because the individual who triggered the arrest are not here and they are the ones to charge me,” she said in a post on her social media.
She had been barred from accessing the precincts in a dramatic incident.
She said the move is shrouded by corruption. “I want to assure those doubting my intentions and my reasons for fighting. This is not about a salary or a position, trust me. By the time this fight comes to an end, the outright corruption and impunity will lay bare for EVERYONE to see. From the Senate Speaker’s office to the Clerk of the Senate all the way down to their errand boys and girls.” “So, don’t be distracted by those trying to make this about the salary or privileges. There is a bigger war here. They will try to use shame to silence me, but they must remember I am shameless!” she said.
There was no immediate comment from the Senate leadership on the issue. Orwoba attempted to force her way into Parliament, challenging her recent replacement.
Orwoba, who was expelled from the UDA party in May, claimed her removal and substitution by Consolata Wakwabubi was illegal.
Claiming to have gone to serve court documents contesting the decision, Orwoba further accused the Senate of holding an unconstitutional sitting.
She warned that any resolutions made, including those on the impeachment motion against Kericho Governor Eric Mutai, would be illegitimate if passed with her replacement present.
“As long as the lady called Consolata is sitting in the Senate even now, that sitting is illegal. That is a stranger on the floor of the house. There is no impeachment by the way that is going on with a stranger on the floor of the House. That is the basis of an appeal for whatever outcome the impeachment will bring out,” she ranted.
“Here are the orders that have been moved up on the street. And the Speaker of the Senate, Amason Kingi, continues to entertain illegality after Katiba Day.”
On August 20, the Political Parties Disputes Tribunal (PPDT) nullified the expulsion of former nominated Senator Gloria Orwoba from the United Democratic Alliance (UDA), citing procedural lapses in the disciplinary proceedings—procedural lapses that breached fundamental principles of fairness. In its judgment, the tribunal chaired by Desma Nungo found that UDA’s disciplinary process violated the principles of natural justice and due process.
“There was no fair opportunity for hearing, and the complainant was not furnished with the impugned decision,” the tribunal ruled.
They noted that key documents, including the complaint dated May 8, were unsigned and undated, while no proof was provided that the decision to expel her was ever served.
These irregularities, it said, stripped the process of legality and fairness. The tribunal’s findings directly challenged the disciplinary committee’s handling of the matter.
Orwoba had been expelled from the party earlier over allegations of disloyalty, claims she dismissed as politically motivated.
UDA maintained that the expulsion was justified and argued before the tribunal that the case was sub judice due to a High Court petition filed earlier by Orwoba.
However, the tribunal dismissed this argument, stating that no current parallel proceedings were ongoing.
