Embakasi East Mp, Paul Ongili otherwise known as Babu Owino risks losing his seat after failing to respond to a petition challenging his win within the timelines as required by law.
The former student leader at the University of Nairobi was supposed to respond to Francis Mureithi’s petition within 7 days which lapsed on 15 September.
Mureithi has named the Mp, Nicholas Buttuk who was the returning officer and the IEBC as first, second and third respondents respectively.
The Jubilee candidate, Mureithi wants the court to order that Babu has conceded to the petition.

“It is now over 12 days from the service of the petition upon Mr Owino and since then no steps have been taken. Therefore the only inference to make is that he has conceded to the petition. No known excuse is available to him for non-compliance,” Mureithi’s lawyer Ham Lagat, told Nairobi News.
