Okiya Omtatah has moved to court under a certificate of urgency to restrain the IEBC from declaring Uhuru Kenyatta as President.

He has also asked Uhuru Kenyatta and Deputy president William Ruto to prepare to vacate office on November 1 as the incumbency period will have elapsed.

Okiya argues that upon the end of the period of incumbency it is the Chief Justice and not the speaker of the national assembly who should thereafter preside over their caretaker government or a parliamentary committee of both NASA and Jubilee to appoint an organ that will be in charge of the caretaker government for a period not later than December 2017.

The Activist went to court following the withdrawal of Raila Odinga as a presidential candidate  in October 26 fresh polls.
