President William Ruto has assented to the Judges’ Retirement Benefits Bill, 2026, at State House, Nairobi, on Monday, March 9.

The new law, known as the Judges’ Retirement Benefits Act, aims to strengthen the Judiciary and protect its independence by guaranteeing retirement benefits and ensuring security of tenure for judges.

“The enactment of the Judges’ Retirement Benefits Act strengthens the Judiciary and reinforces its independence by guaranteeing retirement benefits and safeguarding security of tenure,” President Ruto said.

The legislation also provides additional benefits for judges, including medical cover, diplomatic passports, and access to government airport lounges, reflecting the demanding nature of judicial service.

The Act replaces the previous system under the Pensions Act and the Pensions (Increase) Act, which had previously governed judicial retirement benefits. The new law is expected to offer more clarity and security for judges as they plan for retirement.
