    Sad Love Story Moves Magistrate, Sets Free ‘Unhygienic’ Roadside Chips Vendor

    A Meru court set free a woman charged with vending food under unhygienic conditions.

    Resident Magistrate Edward Tsimonjero found the suspect, Josey Karendi, guilty of the offence but was moved by the circumstances that led to the offence informing the decision to set the woman free.

    While taking plea, a tearful Miss Karendi narrated how the only love of her life dumped her after realizing she was expectant.

    She told the court that selling chips by the roadside in Meru town was the last resort to feed her now 6-month-old daughter.

    “Tulikuwa tunakaa na yeye lakini wakati nilipata boli akaniwacha na sijawahi muona tangu wakati huo,” she told Mr Tsimonjero.

    To prove their case, the prosecution brought a deep frying pan with about two plates of chips as evidence.

    While the charges were being read, Miss Karendi broke down, prompting the curious Magistrate to ask her if the allegations raised were correct.

    After listening carefully to both sides, the Magistrate was moved by Karendi’s story saying it was touching, and ruled in favor of the woman.

    He however, advised Karendi to improve the hygiene at her place of work.

    “We have listened to your mitigation and the circumstances under which the offence was committed. Consequently, the accused is discharged 35 (1) of the penal code. You must strive to maintain high standards of hygiene,” said Mr Tsimonjero.
