The National Land Commission (NLC) has maintained that the land on which Airgate Mall, formerly Taj Mall sits is owned by the government.
According to the commission, Kenya Urban Roads Authority (KURA) stated in a complaint dated June 14 2013 that the “road corridor from North Airport Road to Ngong River was acquired by the Government in 1960 and the Road Survey executed in 1966.”
“The Commission received a complaint on 14th June 2013, from Kenya Urban Roads Authority requesting it to review grants for parcels located along Outer-Ring Road to determine their legality or propriety. LR 209/13938- Taj Mall, was among the parcels of land received,” NLC said in a statement.
The lands commission further clarifies that the land was acquired for the construction of Oute-Ring Road in a gazette notice No.1105 of April 30, 1971 and Airgate mall’s title deed revoked.

Nairobi Regeneration committee head of operations Julius Wanjau on Sunday said the demolition of the Rameshchandra Govino Gorasia owned property, will begin this week.
Mr Gorasia had on August 16 received a 14 day notice to bring down the multi billion shilling building down but remained defiant.
“We are still doing South End Mall and we are hopeful to clear it before next week. We have given the owners ample time to comply with the notice before we move in starting next week. The demolition of Airgate will take place anytime within the week but we will communicate on the same,” Wanjau said.
According to a gazette notice of January 22, 2016, the commission also revoked title deeds belonging to Oil Libya Petrol Station, Safeway Supermarket, Jogoo Outering petrol station, Gulf Energy petrol station all in Nairobi’s Embakasi area.
Fedha Estate’s title deed, Kahawa Tungu has learnt was also revoked.
