    Court suspends NTSA move to bar Nicco Movers Limited operations

    The High Court has temporarily suspended the enforcement of a decision barring Nicco Movers Limited from operating, granting the transport company interim relief pending further orders.

    Justice Janet Mulwa on Wednesday certified the application as urgent and stayed the decision of the Transport Licensing Appeals Board issued on August 31, 2026.

    The court directed Nicco Movers to serve the respondents within 24 hours and set the matter for mention on September 22, 2026.

    “In the interim, pursuant to powers granted to the court under Section 3A of the Civil Procedure Act to make any orders necessary for the ends of justice, Prayer 4 of the motion is hereby granted. To that end, an interim order of stay of execution of NTSA judgment and orders are all stayed to last upto 22/9/2026 when further orders shall be issued,” ruled the court.

    Nicco Movers, through their lawyer Danstan Omari, is challenging the tribunal’s ruling, which suspended its licence over alleged safety and compliance failures.

    The tribunal had found widespread defects across the company’s fleet following investigations triggered by two fatal incidents involving its buses along Thika Superhighway within six months.

    One crash, which occurred on January 11, 2026, near Kenyatta University and Kahawa Sukari, claimed the life of a pedestrian.

    The second occurred on June 5, 2026, when Kenya Medical Training College student Eugene Mutivi Mutuku died after falling from a moving Nicco Movers vehicle near Waumini Radio Station.

    While the student’s mother alleged he was pushed out by a conductor, the company maintained he jumped from the vehicle.

    The tribunal declined to determine the conflicting accounts, saying the issue falls within the criminal justice process.

    An NTSA inspection further revealed that 45 of the 51 vehicles presented by the company failed mandatory safety checks.

    Inspectors cited defective seat belts, faulty doors and window locks, malfunctioning lights and horns, damaged body panels, and missing emergency equipment including fire extinguishers and first-aid kits.

    The authority also found multiple speeding violations, vehicles with expired inspection certificates, and buses failing to transmit speed-limiter data.

    Although the tribunal upheld NTSA’s safety concerns, it ruled that revoking the operator’s licence was excessive and instead imposed an immediate suspension while directing the company to address ten compliance issues.

    “The Respondent’s decision revoking the Appellant’s PSV Operator Licence, communicated by letter referenced NTSA/C/RT/96/1VOL. (1) and dated 9th June 2026, is hereby set aside. In substitution thereof, the Appellant’s PSV Operator Licence is suspended with immediate effect,” ruled the tribunal.

    “The Appellant shall within seven (7) days address the ten (10) “concerns and way forward” items listed in the Respondent’s annexure marked “AK-7″ bearing the Minutes of Show-Cause Hearings on Traffic Violations held on 12th June 2026.”
